ہم سے قتیبہ بن سعید نے بیان کیا، انہوں نے کہا کہ ہم سے امام مالک نے بیان کیا، ان سے ابن شہاب نے بیان کیا، ان سے ابوبکر بن عبدالرحمٰن بن حارث بن ہشام نے بیان کیا، ان سے ابومسعود انصاری رضی اللہ عنہ نے بیان کیا کہ رسول اللہ صلی اللہ علیہ وسلم نے کتے کی قیمت، زانیہ ( کے زنا ) کی خرچی اور کاہن کی مزدوری سے منع فرمایا۔
Narrated Abu Huraira:The Prophet (ﷺ) prohibited the earnings of slave girls (through prostitution)
ہم سے مسلم بن ابراہیم نے بیان کیا، کہا ہم سے شعبہ نے بیان کیا، ان سے محمد بن حجادہ نے بیان کیا، ان سے ابوحازم نے اور ان سے ابوہریرہ رضی اللہ عنہ نے کہ نبی کریم صلی اللہ علیہ وسلم نے باندیوں کی زنا کی کمائی سے منع فرمایا تھا۔
Narrated Ibn `Umar:The Prophet (ﷺ) forbade taking a price for animal copulation
ہم سے مسدد بن مسرہد نے بیان کیا، کہا کہ ہم سے عبدالوارث اور اسماعیل بن ابراہیم نے بیان کیا، ان سے علی بن حکم نے، ان سے نافع نے اور ان سے ابن عمر رضی اللہ عنہما نے بیان کیا کہ نبی کریم صلی اللہ علیہ وسلم نے نرکدانے کی اجرت لینے سے منع فرمایا۔
Narrated `Abdullah bin `Umar:"Allah's Messenger (ﷺ) gave the land of Khaibar to the Jews to work on and cultivate and take half of its yield. Ibn `Umar added, "The land used to be rented for a certain portion (of its yield)." Nafi` mentioned the amount of the portion but I forgot it. Rafi` bin Khadij said, "The Prophet (ﷺ) forbade renting farms." Narrated 'Ubaidullah Nafi` said: Ibn `Umar said: (The contract of Khaibar continued) till `Umar evacuated the Jews (from Khaibar)

ہم سے عبداللہ بن یوسف نے بیان کیا، کہا کہ ہم کو امام مالک رحمہ اللہ نے خبر دی، انہیں ابوالزناد نے، انہیں اعرج نے اور انہیں ابوہریرہ رضی اللہ عنہ نے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ( قرض ادا کرنے میں ) مالدار کی طرف سے ٹال مٹول کرنا ظلم ہے۔ اور اگر تم میں سے کسی کا قرض کسی مالدار پر حوالہ دیا جائے تو اسے قبول کرے۔

ہم سے محمد بن یوسف نے بیان کیا، کہا کہ ہم سے سفیان ثوری نے بیان کیا، ان سے ابن ذکوان نے، ان سے اعرج نے اور ان سے ابوہریرہ رضی اللہ عنہ نے کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا، مالدار کی طرف سے ( قرض ادا کرنے میں ) ٹال مٹول کرنا ظلم ہے۔ اور اگر کسی کا قرض کسی مالدار کے حوالہ کیا جائے تو وہ اسے قبول کرے۔
Narrated Salama bin Al-Akwa: Once, while we were sitting in the company of Prophet, a dead man was brought. The Prophet (ﷺ) was requested to lead the funeral prayer for the deceased. He said, "Is he in debt?" The people replied in the negative. He said, "Has he left any wealth?" They said, "No." So, he led his funeral prayer. Another dead man was brought and the people said, "O Allah's Messenger (ﷺ)! Lead his funeral prayer." The Prophet (ﷺ) said, "Is he in debt?" They said, "Yes." He said, "Has he left any wealth?" They said, ''Three Dinars." So, he led the prayer. Then a third dead man was brought and the people said (to the Prophet (ﷺ) ), Please lead his funeral prayer." He said, "Has he left any wealth?" They said, "No." He asked, "Is he in debt?" They said, ("Yes! He has to pay) three Dinars.', He (refused to pray and) said, "Then pray for your (dead) companion." Abu Qatada said, "O Allah's Messenger (ﷺ)! Lead his funeral prayer, and I will pay his debt." So, he led the prayer
ہم سے مکی بن ابراہیم نے بیان کیا، کہا کہ ہم سے یزید بن ابی عبید نے بیان کیا، ان سے سلمہ بن اکوع رضی اللہ عنہ نے کہ ہم نبی کریم صلی اللہ علیہ وسلم کی خدمت میں موجود تھے کہ ایک جنازہ لایا گیا۔ لوگوں نے آپ صلی اللہ علیہ وسلم سے عرض کیا کہ اس کی نماز پڑھا دیجئیے۔ اس پر آپ صلی اللہ علیہ وسلم نے پوچھا کیا اس پر کوئی قرض ہے؟ لوگوں نے بتایا کہ نہیں کوئی قرض نہیں ہے۔ آپ صلی اللہ علیہ وسلم نے دریافت فرمایا کہ میت نے کچھ مال بھی چھوڑا ہے؟ لوگوں نے عرض کیا کوئی مال بھی نہیں چھوڑا۔ آپ صلی اللہ علیہ وسلم نے ان کی نماز جنازہ پڑھائی۔ اس کے بعد ایک دوسرا جنازہ لایا گیا لوگوں نے عرض کیا یا رسول اللہ! آپ ان کی بھی نماز جنازہ پڑھا دیجئیے۔ نبی کریم صلی اللہ علیہ وسلم نے دریافت فرمایا، کسی کا قرض بھی میت پر ہے؟ عرض کیا گیا کہ ہے۔ پھر آپ صلی اللہ علیہ وسلم نے دریافت فرمایا، کچھ مال بھی چھوڑا ہے؟ لوگوں نے کہا کہ تین دینار چھوڑے ہیں۔ آپ نے ان کی بھی نماز جنازہ پڑھائی۔ پھر تیسرا جنازہ لایا گیا۔ لوگوں نے آپ کی خدمت میں عرض کیا کہ اس کی نماز پڑھا دیجئیے۔ نبی کریم صلی اللہ علیہ وسلم نے ان کے متعلق بھی وہی دریافت فرمایا، کیا کوئی مال ترکہ چھوڑا ہے؟ لوگوں نے کہا کہ نہیں۔ آپ صلی اللہ علیہ وسلم نے دریافت فرمایا، اور اس پر کسی کا قرض بھی ہے؟ لوگوں نے کہا کہ ہاں تین دینار ہیں۔ آپ صلی اللہ علیہ وسلم نے اس پر فرمایا کہ پھر اپنے ساتھی کی تم ہی لوگ نماز پڑھ لو۔ ابوقتادۃ رضی اللہ عنہ بولے، یا رسول اللہ! آپ صلی اللہ علیہ وسلم ان کی نماز پڑھا دیجئیے، ان کا قرض میں ادا کر دوں گا۔ تب آپ صلی اللہ علیہ وسلم نے اس پر نماز پڑھائی۔
Narrated Muhammad bin 'Amr Al-Aslami that his father Hamza said:'Umar (ra) sent him (i.e. Hamza) as a Sadaqa / Zakat collector. A man had committed illegal sexual intercourse with the slave girl of his wife. Hamza took (personal) sureties for the adulterer till they came to 'Umar. 'Umar had lashed the adulterer one hundred lashes. 'Umar confirmed their claim (that the adulterer had already been punished) and excused him because of being Ignorant. Jarir Al-Ash'ath said to Ibn Mas'ud regarding renegades (i.e., those who became infidels after embracing Islam), "Let them repent and take (personal) sureties for them." They repented and their relatives stood sureties for them. According to Hammad, if somebody stands surety for another person and that person dies, the person giving surety will be released from responsibility. اور ابوالزناد نے بیان کیا، ان سے محمد بن حمزہ بن عمرو الاسلمی نے اور ان سے ان کے والد (حمزہ) نے کہ عمر رضی اللہ عنہ نے ( اپنے عہد خلافت میں ) انہیں زکوٰۃ وصول کرنے کے لیے بھیجا۔ ( جہاں وہ زکوٰۃ وصول کر رہے تھے وہاں کے ) ایک شخص نے اپنی بیوی کی باندی سے ہمبستری کر لی۔ حمزہ نے اس کی ایک شخص سے پہلے ضمانت لی، یہاں تک کہ وہ عمر رضی اللہ عنہ کی خدمت میں حاضر ہوئے۔ عمر رضی اللہ عنہ نے اس شخص کو سو کوڑوں کی سزا دی تھی۔ اس آدمی نے جو جرم اس پر لگا تھا اس کو قبول کیا تھا لیکن جہالت کا عذر کیا تھا۔ عمر رضی اللہ عنہ نے اس کو معذور رکھا تھا اور جریر اور اشعث نے عبداللہ بن مسعود سے مرتدوں کے بارے میں کہا کہ ان سے توبہ کرائیے اور ان کی ضمانت طلب کیجئے ( کہ دوبارہ مرتد نہ ہوں گے ) چنانچہ انہوں نے توبہ کر لی اور ضمانت خود انہیں کے قبیلہ والوں نے دے دی۔ حماد نے کہا جس کا حاضر ضامن ہو اگر وہ مر جائے تو ضامن پر کچھ تاوان نہ ہو گا۔ لیکن حکم نے کہا کہ ذمہ کا مال دینا پڑے گا۔
Narrated Abu Huraira: The Prophet (ﷺ) said, "An Israeli man asked another Israeli to lend him one thousand Dinars. The second man required witnesses. The former replied, 'Allah is sufficient as a witness.' The second said, 'I want a surety.' The former replied, 'Allah is sufficient as a surety.' The second said, 'You are right,' and lent him the money for a certain period. The debtor went across the sea. When he finished his job, he searched for a conveyance so that he might reach in time for the repayment of the debt, but he could not find any. So, he took a piece of wood and made a hole in it, inserted in it one thousand Dinars and a letter to the lender and then closed (i.e. sealed) the hole tightly. He took the piece of wood to the sea and said. 'O Allah! You know well that I took a loan of one thousand Dinars from so-and-so. He demanded a surety from me but I told him that Allah's Guarantee was sufficient and he accepted Your guarantee. He then asked for a witness and I told him that Allah was sufficient as a Witness, and he accepted You as a Witness. No doubt, I tried hard to find a conveyance so that I could pay his money but could not find, so I hand over this money to You.' Saying that, he threw the piece of wood into the sea till it went out far into it, and then he went away. Meanwhile he started searching for a conveyance in order to reach the creditor's country. One day the lender came out of his house to see whether a ship had arrived bringing his money, and all of a sudden he saw the piece of wood in which his money had been deposited. He took it home to use for fire. When he sawed it, he found his money and the letter inside it. Shortly after that, the debtor came bringing one thousand Dinars to him and said, 'By Allah, I had been trying hard to get a boat so that I could bring you your money, but failed to get one before the one I have come by.' The lender asked, 'Have you sent something to me?' The debtor replied, 'I have told you I could not get a boat other than the one I have come by.' The lender said, 'Allah has delivered on your behalf the money you sent in the piece of wood. So, you may keep your one thousand Dinars and depart guided on the right path
ابوعبداللہ (امام بخاری رحمہ اللہ) نے کہا کہ لیث نے بیان کیا، ان سے جعفر بن ربیعہ نے، ان سے عبدالرحمٰن بن ہرمز نے اور ان سے ابوہریرہ رضی اللہ عنہ نے کہ رسول اللہ صلی اللہ علیہ وسلم نے بنی اسرائیل کے ایک شخص کا ذکر فرمایا کہ انہوں نے بنی اسرائیل کے ایک دوسرے آدمی سے ایک ہزار دینار قرض مانگے۔ انہوں نے کہا کہ پہلے ایسے گواہ لا جن کی گواہی پر مجھے اعتبار ہو۔ قرض مانگنے والا بولا کہ گواہ تو بس اللہ ہی کافی ہے پھر انہوں نے کہا کہ اچھا کوئی ضامن لا۔ قرض مانگنے والا بولا کہ ضامن بھی اللہ ہی کافی ہے۔ انہوں نے کہا کہ تو نے سچی بات کہی۔ چنانچہ اس نے ایک مقررہ مدت کے لیے اس کو قرض دے دیا۔ یہ صاحب قرض لے کر دریائی سفر پر روانہ ہوئے اور پھر اپنی ضرورت پوری کر کے کسی سواری ( کشتی وغیرہ ) کی تلاش کی تاکہ اس سے دریا پار کر کے اس مقررہ مدت تک قرض دینے والے کے پاس پہنچ سکے جو اس سے طے پائی تھی۔ ( اور اس کا قرض ادا کر دے ) لیکن کوئی سواری نہیں ملی۔ آخر ایک لکڑی لی اور اس میں سوراخ کیا۔ پھر ایک ہزار دینار اور ایک ( اس مضمون کا ) خط کہ اس کی طرف سے قرض دینے والے کی طرف ( یہ دینار بھیجے جا رہے ہیں ) اور اس کا منہ بند کر دیا۔ اور اسے دریا پر لے آئے، پھر کہا، اے اللہ! تو خوب جانتا ہے کہ میں نے فلاں شخص سے ایک ہزار دینار قرض لیے تھے۔ اس نے مجھ سے ضامن مانگا تو میں نے کہہ دیا تھا کہ میرا ضامن اللہ تعالیٰ کافی ہے اور وہ بھی تجھ پر راضی ہوا۔ اس نے مجھ سے گواہ مانگا تو اس کا بھی جواب میں نے یہی دیا کہ اللہ پاک گواہ کافی ہے تو وہ مجھ پر راضی ہو گیا اور ( تو جانتا ہے کہ ) میں نے بہت کوشش کی کہ کوئی سواری ملے جس کے ذریعہ میں اس کا قرض اس تک ( مدت مقررہ میں ) پہنچا سکوں۔ لیکن مجھے اس میں کامیابی نہیں ہوئی۔ اس لیے اب میں اس کو تیرے ہی حوالے کرتا ہوں ( کہ تو اس تک پہنچا دے ) چنانچہ اس نے وہ لکڑی جس میں رقم تھی دریا میں بہا دی۔ اب وہ دریا میں تھی اور وہ صاحب ( قرض دار ) واپس ہو چکے تھے۔ اگرچہ فکر اب بھی یہی تھا کہ کس طرح کوئی جہاز ملے۔ جس کے ذریعہ وہ اپنے شہر میں جا سکیں۔ دوسری طرف وہ صاحب جنہوں نے قرض دیا تھا اسی تلاش میں ( بندرگاہ ) آئے کہ ممکن ہے کوئی جہاز ان کا مال لے کر آیا ہو۔ لیکن وہاں انہیں ایک لکڑی ملی۔ وہی جس میں مال تھا۔ انہوں نے لکڑی اپنے گھر میں ایندھن کے لیے لے لی۔ لیکن جب اسے چیرا تو اس میں سے دینار نکلے اور ایک خط بھی نکلا۔ ( کچھ دنوں کے بعد جب وہ صاحب اپنے شہر آئے ) تو قرض خواہ کے گھر آئے۔ اور ( یہ خیال کر کے کہ شاید وہ لکڑی نہ مل سکی ہو دوبارہ ) ایک ہزار دینا ان کی خدمت میں پیش کر دیئے۔ اور کہا کہ قسم اللہ کی! میں تو برابر اسی کوشش میں رہا کہ کوئی جہاز ملے تو تمہارے پاس تمہارا مال لے کر پہنچوں لیکن اس دن سے پہلے جب کہ میں یہاں پہنچنے کے لیے سوار ہوا۔ مجھے اپنی کوششوں میں کامیابی نہیں ہوئی۔ پھر انہوں نے پوچھا اچھا یہ تو بتاؤ کہ کوئی چیز کبھی تم نے میرے نام بھیجی تھی؟ مقروض نے جواب دیا بتا تو رہا ہوں آپ کو کہ کوئی جہاز مجھے اس جہاز سے پہلے نہیں ملا جس سے میں آج پہنچا ہوں۔ اس پر قرض خواہ نے کہا کہ پھر اللہ نے بھی آپ کا وہ قرضا ادا کر دیا۔ جسے آپ نے لکڑی میں بھیجا تھا۔ چنانچہ وہ صاحب اپنا ہزار دینار لے کر خوش خوش واپس لوٹ گئے۔
