حَدَّثَنَا آدَمُ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، حَدَّثَنَا الزُّهْرِيُّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، رضى الله عنهما قَالاَ جَاءَ أَعْرَابِيٌّ فَقَالَ يَا رَسُولَ اللَّهِ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ‏.‏ فَقَامَ خَصْمُهُ فَقَالَ صَدَقَ، اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ‏.‏ فَقَالَ الأَعْرَابِيُّ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا، فَزَنَى بِامْرَأَتِهِ، فَقَالُوا لِي عَلَى ابْنِكَ الرَّجْمُ‏.‏ فَفَدَيْتُ ابْنِي مِنْهُ بِمِائَةٍ مِنَ الْغَنَمِ وَوَلِيدَةٍ، ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ، فَقَالُوا إِنَّمَا عَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ‏.‏ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏ "‏ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ، أَمَّا الْوَلِيدَةُ وَالْغَنَمُ فَرَدٌّ عَلَيْكَ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَأَمَّا أَنْتَ يَا أُنَيْسُ ـ لِرَجُلٍ ـ فَاغْدُ عَلَى امْرَأَةِ هَذَا فَارْجُمْهَا ‏"‏‏.‏ فَغَدَا عَلَيْهَا أُنَيْسٌ فَرَجَمَهَا‏.‏
Translation:

Narrated Abu Huraira and Zaid bin Khalid Al-Juhani:A bedouin came and said, "O Allah's Messenger (ﷺ)! Judge between us according to Allah's Laws." His opponent got up and said, "He is right. Judge between us according to Allah's Laws." The bedouin said, "My son was a laborer working for this man, and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death; so, in lieu of that, I paid a ransom of one hundred sheep and a slave girl to save my son. Then I asked the learned scholars who said, "Your son has to be lashed one-hundred lashes and has to be exiled for one year." The Prophet (ﷺ) said, "No doubt I will judge between you according to Allah's Laws. The slave-girl and the sheep are to go back to you, and your son will get a hundred lashes and one year exile." He then addressed somebody, "O Unais! go to the wife of this (man) and stone her to death" So, Unais went and stoned her to death

ہم سے آدم نے بیان کیا، کہا ہم سے ابن ابی ذئب نے بیان کیا، کہا ہم سے زہری نے بیان کیا، ان سے عبیداللہ بن عبداللہ نے اور ان سے ابوہریرہ اور زید بن خالد جہنی رضی اللہ عنہما نے بیان کیا کہ ایک دیہاتی آیا اور عرض کیا، یا رسول اللہ! ہمارے درمیان کتاب اللہ سے فیصلہ کر دیجئیے۔ دوسرے فریق نے بھی یہی کہا کہ اس نے سچ کہا ہے۔ آپ ہمارا فیصلہ کتاب اللہ کے مطابق کر دیں۔ دیہاتی نے کہا کہ میرا لڑکا اس کے یہاں مزدور تھا۔ پھر اس نے اس کی بیوی سے زنا کیا۔ قوم نے کہا تمہارے لڑکے کو رجم کیا جائے گا، لیکن میں نے اپنے لڑکے کے اس جرم کے بدلے میں سو بکریاں اور ایک باندی دے دی، پھر میں نے علم والوں سے پوچھا تو انہوں نے بتایا کہ اس کے سوا کوئی صورت نہیں کہ تمہارے لڑکے کو سو کوڑے لگائے جائیں اور ایک سال کے لیے ملک بدر کر دیا جائے۔ نبی کریم صلی اللہ علیہ وسلم نے فرمایا ”میں تمہارا فیصلہ کتاب اللہ ہی سے کروں گا۔ باندی اور بکریاں تو تمہیں واپس لوٹا دی جاتی ہیں، البتہ تمہارے لڑکے کو سو کوڑے لگائے جائیں گے اور ایک سال کے لیے ملک بدر کیا جائے گا اور انیس تم ( یہ قبیلہ اسلم کے صحابی تھے ) اس عورت کے گھر جاؤ اور اسے رجم کر دو ( اگر وہ زنا کا اقرار کر لے ) چنانچہ انیس گئے، اور ( چونکہ اس نے بھی زنا کا اقرار کر لیا تھا اس لیے ) اسے رجم کر دیا۔“

Translation:

Narrated Abu Huraira and Zaid bin Khalid Al-Juhani:A bedouin came and said, "O Allah's Messenger (ﷺ)! Judge between us according to Allah's Laws." His opponent got up and said, "He is right. حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ إِسْرَائِيلَ، عَنْ أَبِي إِسْحَاقَ، عَنِ الْبَرَاءِ ـ رضى الله عنه ـ قَالَ اعْتَمَرَ النَّبِيُّ صلى الله عليه وسلم فِي ذِي الْقَعْدَةِ، فَأَبَى أَهْلُ مَكَّةَ أَنْ يَدَعُوهُ يَدْخُلُ مَكَّةَ، حَتَّى قَاضَاهُمْ عَلَى أَنْ يُقِيمَ بِهَا ثَلاَثَةَ أَيَّامٍ، فَلَمَّا كَتَبُوا الْكِتَابَ كَتَبُوا هَذَا مَا قَاضَى عَلَيْهِ مُحَمَّدٌ رَسُولُ اللَّهِ صلى الله عليه وسلم‏.‏ فَقَالُوا لاَ نُقِرُّ بِهَا، فَلَوْ نَعْلَمُ أَنَّكَ رَسُولُ اللَّهِ مَا مَنَعْنَاكَ، لَكِنْ أَنْتَ مُحَمَّدُ بْنُ عَبْدِ اللَّهِ‏.‏ قَالَ ‏"‏ أَنَا رَسُولُ اللَّهِ وَأَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ ‏"‏‏.‏ ثُمَّ قَالَ لِعَلِيٍّ ‏"‏ امْحُ رَسُولُ اللَّهِ ‏"‏‏.‏ قَالَ لاَ، وَاللَّهِ لاَ أَمْحُوكَ أَبَدًا، فَأَخَذَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْكِتَابَ، فَكَتَبَ هَذَا مَا قَاضَى عَلَيْهِ مُحَمَّدُ بْنُ عَبْدِ اللَّهِ، لاَ يَدْخُلُ مَكَّةَ سِلاَحٌ إِلاَّ فِي الْقِرَابِ، وَأَنْ لاَ يَخْرُجَ مِنْ أَهْلِهَا بِأَحَدٍ، إِنْ أَرَادَ أَنْ يَتَّبِعَهُ، وَأَنْ لاَ يَمْنَعَ أَحَدًا مِنْ أَصْحَابِهِ أَرَادَ أَنْ يُقِيمَ بِهَا‏.‏ فَلَمَّا دَخَلَهَا، وَمَضَى الأَجَلُ أَتَوْا عَلِيًّا، فَقَالُوا قُلْ لِصَاحِبِكَ اخْرُجْ عَنَّا فَقَدْ مَضَى الأَجَلُ‏.‏ فَخَرَجَ النَّبِيُّ صلى الله عليه وسلم فَتَبِعَتْهُمُ ابْنَةُ حَمْزَةَ يَا عَمِّ يَا عَمِّ‏.‏ فَتَنَاوَلَهَا عَلِيٌّ فَأَخَذَ بِيَدِهَا، وَقَالَ لِفَاطِمَةَ عَلَيْهَا السَّلاَمُ دُونَكِ ابْنَةَ عَمِّكِ، احْمِلِيهَا‏.‏ فَاخْتَصَمَ فِيهَا عَلِيٌّ وَزَيْدٌ وَجَعْفَرٌ، فَقَالَ عَلِيٌّ أَنَا أَحَقُّ بِهَا وَهْىَ ابْنَةُ عَمِّي‏.‏ وَقَالَ جَعْفَرٌ ابْنَةُ عَمِّي وَخَالَتُهَا تَحْتِي‏.‏ وَقَالَ زَيْدٌ ابْنَةُ أَخِي‏.‏ فَقَضَى بِهَا النَّبِيُّ صلى الله عليه وسلم لِخَالَتِهَا‏.‏ وَقَالَ ‏"‏ الْخَالَةُ بِمَنْزِلَةِ الأُمِّ ‏"‏‏.‏ وَقَالَ لِعَلِيٍّ ‏"‏ أَنْتَ مِنِّي وَأَنَا مِنْكَ ‏"‏‏.‏ وَقَالَ لِجَعْفَرٍ ‏"‏ أَشْبَهْتَ خَلْقِي وَخُلُقِي ‏"‏‏.‏ وَقَالَ لِزَيْدٍ ‏"‏ أَنْتَ أَخُونَا وَمَوْلاَنَا ‏"‏‏.‏
Translation:

Narrated Al-Bara:When the Prophet (ﷺ) intended to perform `Umra in the month of Dhul-Qada, the people of Mecca did not let him enter Mecca till he settled the matter with them by promising to stay in it for three days only. When the document of treaty was written, the following was mentioned: 'These are the terms on which Muhammad, Allah's Messenger (ﷺ) agreed (to make peace).' They said, "We will not agree to this, for if we believed that you are Allah's Messenger (ﷺ) we would not prevent you, but you are Muhammad bin `Abdullah." The Prophet (ﷺ) said, "I am Allah's Messenger (ﷺ) and also Muhammad bin `Abdullah." Then he said to `Ali, "Rub off (the words) 'Allah's Messenger (ﷺ)' ", but `Ali said, "No, by Allah, I will never rub off your name." So, Allah's Messenger (ﷺ) took the document and wrote, 'This is what Muhammad bin `Abdullah has agreed upon: No arms will be brought into Mecca except in their cases, and nobody from the people of Mecca will be allowed to go with him (i.e. the Prophet (ﷺ) ) even if he wished to follow him and he (the Prophet (ﷺ) ) will not prevent any of his companions from staying in Mecca if the latter wants to stay.' When the Prophet (ﷺ) entered Mecca and the time limit passed, the Meccans went to `Ali and said, "Tell your Friend (i.e. the Prophet (ﷺ) ) to go out, as the period (agreed to) has passed." So, the Prophet (ﷺ) went out of Mecca. The daughter of Hamza ran after them (i.e. the Prophet (ﷺ) and his companions), calling, "O Uncle! O Uncle!" `Ali received her and led her by the hand and said to Fatima, "Take your uncle's daughter." Zaid and Ja`far quarreled about her. `Ali said, "I have more right to her as she is my uncle's daughter." Ja`far said, "She is my uncle's daughter, and her aunt is my wife." Zaid said, "She is my brother's daughter." The Prophet (ﷺ) judged that she should be given to her aunt, and said that the aunt was like the mother. He then said to 'Ali, "You are from me and I am from you", and said to Ja`far, "You resemble me both in character and appearance", and said to Zaid, "You are our brother (in faith) and our freed slave

ہم سے عبیداللہ بن موسیٰ نے بیان کیا اسرائیل سے، ان سے ابواسحاق نے اور ان سے براء بن عازب رضی اللہ عنہ نے بیان کیا کہ رسول اللہ صلی اللہ علیہ وسلم نے ذی قعدہ کے مہینے میں عمرہ کا احرام باندھا۔ لیکن مکہ والوں نے آپ صلی اللہ علیہ وسلم کو شہر میں داخل نہیں ہونے دیا۔ آخر صلح اس پر ہوئی کہ ( آئندہ سال ) آپ صلی اللہ علیہ وسلم مکہ میں تین روز قیام کریں گے۔ جب صلح نامہ لکھا جانے لگا تو اس میں لکھا گیا کہ یہ وہ صلح نامہ ہے جو محمد رسول اللہ صلی اللہ علیہ وسلم نے کیا ہے۔ لیکن مشرکین نے کہا کہ ہم تو اسے نہیں مانتے۔ اگر ہمیں علم ہو جائے کہ آپ اللہ کے رسول ہیں تو ہم آپ کو نہ روکیں۔ بس آپ صرف محمد بن عبداللہ ہیں۔ آپ صلی اللہ علیہ وسلم نے فرمایا کہ میں رسول اللہ بھی ہوں اور محمد بن عبداللہ بھی ہوں۔ اس کے بعد آپ نے علی رضی اللہ عنہ سے فرمایا کہ رسول اللہ کا لفظ مٹا دو، انہوں نے عرض کیا نہیں اللہ کی قسم! میں تو یہ لفظ کبھی نہ مٹاؤں گا۔ آخر آپ صلی اللہ علیہ وسلم نے خود دستاویز لی اور لکھا کہ یہ اس کی دستاویز ہے کہ محمد بن عبداللہ نے اس شرط پر صلح کی ہے کہ مکہ میں وہ ہتھیار میان میں رکھے بغیر داخل نہ ہوں گے۔ اگر مکہ کا کوئی شخص ان کے ساتھ جانا چاہے گا تو وہ اسے ساتھ نہ لے جائیں گے۔ لیکن اگر ان کے اصحاب میں سے کوئی شخص مکہ میں رہنا چاہے گا تو اسے وہ نہ روکیں گے۔ جب ( آئندہ سال ) آپ صلی اللہ علیہ وسلم مکہ تشریف لے گئے اور ( مکہ میں قیام کی ) مدت پوری ہو گئی تو قریش علی رضی اللہ عنہ کے پاس آئے اور کہا کہ اپنے صاحب سے کہئے کہ مدت پوری ہو گئی ہے اور اب وہ ہمارے یہاں سے چلے جائیں۔ چنانچہ نبی کریم صلی اللہ علیہ وسلم مکہ سے روانہ ہونے لگے۔ اس وقت حمزہ رضی اللہ عنہ کی ایک بچی چچا چچا کرتی آئیں۔ علی رضی اللہ عنہ نے انہیں اپنے ساتھ لے لیا، پھر فاطمہ رضی اللہ عنہا کے پاس ہاتھ پکڑ کر لائے اور فرمایا، اپنی چچا زاد بہن کو بھی ساتھ لے لو، انہوں نے اس کو اپنے ساتھ سوار کر لیا، پھر علی، زید اور جعفر رضی اللہ عنہم کا جھگڑا ہوا۔ علی رضی اللہ عنہ نے فرمایا کہ اس کا میں زیادہ مستحق ہوں، یہ میرے چچا کی بچی ہے۔ جعفر رضی اللہ عنہ نے فرمایا کہ یہ میرے بھی چچا کی بچی ہے اور اس کی خالہ میرے نکاح میں بھی ہیں۔ زید رضی اللہ عنہ نے فرمایا کہ میرے بھائی کی بچی ہے۔ نبی کریم صلی اللہ علیہ وسلم نے بچی کی خالہ کے حق میں فیصلہ کیا اور فرمایا کہ خالہ ماں کی جگہ ہوتی ہے، پھر علی رضی اللہ عنہ سے فرمایا کہ تم مجھ سے ہو اور میں تم سے ہوں۔ جعفر رضی اللہ عنہ سے فرمایا کہ تم صورت اور عادات و اخلاق سب میں مجھ سے مشابہ ہو۔ زید رضی اللہ عنہ سے فرمایا کہ تم ہمارے بھائی بھی ہو اور ہمارے مولا بھی۔

حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ، حَدَّثَنَا اللَّيْثُ، عَنْ عُقَيْلٍ، عَنِ ابْنِ شِهَابٍ، قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، أَنَّهُ سَمِعَ مَرْوَانَ، وَالْمِسْوَرَ بْنَ مَخْرَمَةَ، رضى الله عنهما يُخْبِرَانِ عَنْ أَصْحَابِ، رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ لَمَّا كَاتَبَ سُهَيْلُ بْنُ عَمْرٍو يَوْمَئِذٍ كَانَ فِيمَا اشْتَرَطَ سُهَيْلُ بْنُ عَمْرٍو عَلَى النَّبِيِّ صلى الله عليه وسلم أَنَّهُ لاَ يَأْتِيكَ مِنَّا أَحَدٌ وَإِنْ كَانَ عَلَى دِينِكَ إِلاَّ رَدَدْتَهُ إِلَيْنَا، وَخَلَّيْتَ بَيْنَنَا وَبَيْنَهُ‏.‏ فَكَرِهَ الْمُؤْمِنُونَ ذَلِكَ، وَامْتَعَضُوا مِنْهُ، وَأَبَى سُهَيْلٌ إِلاَّ ذَلِكَ، فَكَاتَبَهُ النَّبِيُّ صلى الله عليه وسلم عَلَى ذَلِكَ، فَرَدَّ يَوْمَئِذٍ أَبَا جَنْدَلٍ عَلَى أَبِيهِ سُهَيْلِ بْنِ عَمْرٍو، وَلَمْ يَأْتِهِ أَحَدٌ مِنَ الرِّجَالِ إِلاَّ رَدَّهُ فِي تِلْكَ الْمُدَّةِ، وَإِنْ كَانَ مُسْلِمًا، وَجَاءَ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ، وَكَانَتْ أُمُّ كُلْثُومٍ بِنْتُ عُقْبَةَ بْنِ أَبِي مُعَيْطٍ مِمَّنْ خَرَجَ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم يَوْمَئِذٍ وَهْىَ عَاتِقٌ، فَجَاءَ أَهْلُهَا يَسْأَلُونَ النَّبِيَّ صلى الله عليه وسلم أَنْ يَرْجِعَهَا إِلَيْهِمْ، فَلَمْ يَرْجِعْهَا إِلَيْهِمْ لِمَا أَنْزَلَ اللَّهُ فِيهِنَّ ‏{‏إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ اللَّهُ أَعْلَمُ بِإِيمَانِهِنَّ‏}‏ إِلَى قَوْلِهِ ‏{‏وَلاَ هُمْ يَحِلُّونَ لَهُنَّ‏}‏‏.‏
Translation:

Narrated Marwan and al-Miswar bin Makhrama:(from the companions of Allah's Messenger (ﷺ)) When Suhail bin `Amr agreed to the Treaty (of Hudaibiya), one of the things he stipulated then, was that the Prophet (ﷺ) should return to them (i.e. the pagans) anyone coming to him from their side, even if he was a Muslim; and would not interfere between them and that person. The Muslims did not like this condition and got disgusted with it. Suhail did not agree except with that condition. So, the Prophet (ﷺ) agreed to that condition and returned Abu Jandal to his father Suhail bin `Amr. Thenceforward the Prophet (ﷺ) returned everyone in that period (of truce) even if he was a Muslim. During that period some believing women emigrants including Um Kulthum bint `Uqba bin Abu Muait who came to Allah's Messenger (ﷺ) and she was a young lady then. Her relative came to the Prophet (ﷺ) and asked him to return her, but the Prophet (ﷺ) did not return her to them for Allah had revealed the following Verse regarding women: "O you who believe! When the believing women come to you as emigrants. Examine them, Allah knows best as to their belief, then if you know them for true believers, Send them not back to the unbelievers, (for) they are not lawful (wives) for the disbelievers, Nor are the unbelievers lawful (husbands) for them

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، حَدَّثَنَا اللَّيْثُ، قَالَ حَدَّثَنِي يَزِيدُ بْنُ أَبِي حَبِيبٍ، عَنْ أَبِي الْخَيْرِ، عَنْ عُقْبَةَ بْنِ عَامِرٍ ـ رضى الله عنه ـ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ أَحَقُّ الشُّرُوطِ أَنْ تُوفُوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ ‏"‏‏.‏
Translation:

Narrated `Uqba bin Amir:Allah's Messenger (ﷺ) said, "From among all the conditions which you have to fulfill, the conditions which make it legal for you to have sexual relations (i.e. the marriage contract) have the greatest right to be fulfilled

اردو:

ہم سے عبداللہ بن یوسف نے بیان کیا، کہا ہم سے لیث نے بیان کیا، کہا کہ مجھ سے یزید بن ابی حبیب نے بیان کیا، ان سے ابوالخیر نے اور ان سے عقبہ بن عامر رضی اللہ عنہ نے بیان کیا کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ”وہ شرطیں جن کے ذریعہ تم نے عورتوں کی شرمگاہوں کو حلال کیا ہے، پوری کی جانے کی سب سے زیادہ مستحق ہیں۔“

Translation:

Narrated Abu Huraira:The Prophet (ﷺ) said, "No town-dweller should sell for a bedouin. Do not practice Najsh (i.e. Do not offer a high price for a thing which you do not want to buy, in order to deceive the people). No Muslim should offer more for a thing already bought by his Muslim brother, nor should he demand the hand of a girl already engaged to another Muslim. A Muslim woman shall not try to bring about The divorce of her sister (i.e. another Muslim woman) in order to take her place herself

اردو:

ہم سے مسدد نے بیان کیا، کہا ہم سے یزید بن زریع نے بیان کیا، ان سے معمر نے بیان کیا، ان سے زہری نے، ان سے سعید نے اور ان سے ابوہریرہ رضی اللہ عنہ نے کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا ”کوئی شہری کسی دیہاتی کا مال تجارت نہ بیچے۔ کوئی شخص نجش نہ کرے اور نہ اپنے بھائی کی لگائی ہوئی قیمت پر بھاؤ بڑھائے۔ نہ کوئی شخص اپنے کسی بھائی کے پیغام نکاح کی موجودگی میں اپنا پیغام بھیجے اور نہ کوئی عورت ( کسی مرد سے ) اپنی بہن کی طلاق کا مطالبہ کرے ( جو اس مرد کے نکاح میں ہو ) تاکہ اس طرح اس کا حصہ بھی خود لے لے۔“

Translation:

Narrated Abu Huraira and Zaid bin Khalid Al-Juhani:A bedouin came to Allah's Messenger (ﷺ) and said, "O Allah's apostle! I ask you by Allah to judge My case according to Allah's Laws." His opponent, who was more learned than he, said, "Yes, judge between us according to Allah's Laws, and allow me to speak." Allah's Messenger (ﷺ) said, "Speak." He (i .e. the bedouin or the other man) said, "My son was working as a laborer for this (man) and he committed illegal sexual intercourse with his wife. The people told me that it was obligatory that my son should be stoned to death, so in lieu of that I ransomed my son by paying one hundred sheep and a slave girl. Then I asked the religious scholars about it, and they informed me that my son must be lashed one hundred lashes, and be exiled for one year, and the wife of this (man) must be stoned to death." Allah's Messenger (ﷺ) said, "By Him in Whose Hands my soul is, I will judge between you according to Allah's Laws. The slave-girl and the sheep are to be returned to you, your son is to receive a hundred lashes and be exiled for one year. You, Unais, go to the wife of this (man) and if she confesses her guilt, stone her to death." Unais went to that woman next morning and she confessed. Allah's Messenger (ﷺ) ordered that she be stoned to death

حَدَّثَنَا مُحَمَّدُ بْنُ عَرْعَرَةَ، حَدَّثَنَا شُعْبَةُ، عَنْ عَدِيِّ بْنِ ثَابِتٍ، عَنْ أَبِي حَازِمٍ، عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنِ التَّلَقِّي، وَأَنْ يَبْتَاعَ الْمُهَاجِرُ لِلأَعْرَابِيِّ، وَأَنْ تَشْتَرِطَ الْمَرْأَةُ طَلاَقَ أُخْتِهَا، وَأَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ، وَنَهَى عَنِ النَّجْشِ، وَعَنِ التَّصْرِيَةِ‏.‏ تَابَعَهُ مُعَاذٌ وَعَبْدُ الصَّمَدِ عَنْ شُعْبَةَ‏.‏ وَقَالَ غُنْدَرٌ وَعَبْدُ الرَّحْمَنِ نُهِيَ‏.‏ وَقَالَ آدَمُ نُهِينَا‏.‏ وَقَالَ النَّضْرُ وَحَجَّاجُ بْنُ مِنْهَالٍ نَهَى‏.‏
Translation:

Narrated Abu Huraira:Allah's Messenger (ﷺ) forbade (1) the meeting of the caravan (of goods) on the way, (2) and that a residing person buys for a bedouin, (3) and that a woman stipulates the divorce of the wife of the would-be husband, (4) and that a man tries to cause the cancellation of a bargain concluded by another. He also forbade An-Najsh (see Hadith 824) and that one withholds the milk in the udder of the animal so that he may deceive people on selling it

ہم سے محمد بن عرعرہ نے بیان کیا، کہا ہم سے شعبہ نے، ان سے عدی بن ثابت نے، ان سے ابوحازم نے اور ان سے ابوہریرہ رضی اللہ عنہ نے کہ رسول اللہ صلی اللہ علیہ وسلم نے ( تجارتی قافلوں کی ) پیشوائی سے منع فرمایا تھا اور اس سے بھی کہ کوئی شہری کسی دیہاتی کا سامان تجارت بیچے اور اس سے بھی کہ کوئی عورت اپنی ( دینی یا نسبی ) بہن کے طلاق کی شرط لگائے اور اس سے کہ کوئی اپنے کسی بھائی کے بھاؤ پر بھاؤ لگائے، اسی طرح آپ صلی اللہ علیہ وسلم نے نجش اور تصریہ سے بھی منع فرمایا۔ محمد بن عرعرہ کے ساتھ اس حدیث کو معاذ بن معاذ اور عبدالصمد بن عبدالوارث نے بھی شعبہ سے روایت کیا ہے اور غندر اور عبدالرحمٰن بن مہدی نے یوں کہا کہ ممانعت کی گئی تھی ( مجہول کے صیغے کے ساتھ ) آدم بن ابی ایاس نے یوں کہا کہ ہمیں منع کیا گیا تھا نضر اور حجاج بن منہال نے یوں کہا کہ منع کیا تھا ( رسول اللہ صلی اللہ علیہ وسلم نے ) ۔
